Boston Bomber's Legal Team Challenges Judge in Death Penalty Case

Attorneys for Boston Marathon bomber Dzhokhar Tsarnaev have requested that the full First Circuit Court of Appeals reconsider their motion to remove U.S. District Judge George A. O'Toole Jr. from overseeing an investigation into potential juror bias. This request follows a July 31 decision by a three-judge panel that rejected their initial bid to remove the judge. The defense is now seeking an en banc rehearing, which would involve all ten active judges of the First Circuit reviewing the case.
